General ordering
1. Applicability
1.1 The present terms are applicable for all legal relations arising between all persons and smart-home.ee run by Smart Home Systems OÜ (hereinafter referred to as smart-home), as a result of purchasing the products from smart-home.
1.2 In addition to the present terms, the legal relations arising as a result of purchasing the products from smart-home are regulated by applicable legislative acts of Estonian Republic.
1.3 In order to provide the best and most secure sevice and for the benefit of smart-home e-shop development, smart-home has the right to amend and supplement the present terms as well as smart-home price list. All terms and pricing changes will be published online on smart-home.ee website. Terms and pricing changes come into effect immediately after their publication on smart-home.ee website. Should the order be placed before the terms change have occured, the legal relations between the client and smart-home are to be regulated according to the conditions which were in force at the time of placing the order, unless provided otherwise by law or the present terms.
2. Pricing
2.1. smart-home e-shop price list is valid for timely paid invoices according to section 4 of the present terms.
3. Shopping cart and order placement
3.1. You can change the number of items you order. To confirm changes click 'update' button. To proceed with payment click 'next'.
3.2. On the next page you will be asked to enter the billing info. Fill in the buyer's credentials and click 'next'. On the next page you will have to confirm the order and choose the payment method.
3.3. Please double-check the billing and shipping information, since quick and uninterrupted delivery of your order depends on the accuracy of the info submitted.
3.4. The contract enters into force the moment the paymet is transferred to Smart-home bank account.
4. Paying for an order
4.1. Please choose the suitable payment method on the billing page.
4.2. Order can be paid for using the following options:
1) Using internet-banking (Swedbank, SEB, Danske или Nordea). All transactions made through Maksekeskus are done using Euros
2) Using invoice. On the order confirmation page click 'request an invoice'. The order confirmation will be sent to your e-mail address, the invoice will be sent after the payment.
3) Deferred payment. To apply click 'Pay by instalment' button on the order confirmation page.
4)Using credit card.All transactions made through Maksekeskus are done using Euros
4.3. Should the placed order not be paid for in 1 days period, it will be cancelled.
4.4. In case of order cancellation or product return the money will be returned the same way which was used when making an order:
1) In case of payment via Internet Banking the sum will be returned to the same bank account from which the payment was made.
2) In case of credit card payment the sum reserved on Your credit card will be canceled.
3) In case of installment purchase the existing installment agreement will be canceled on the grounds of application sent to the e-mail info@smart-home.ee
Also the cost of services provided by Smart-home shop (for example, transportation, installation, removal of old equipment etc.) will be restrained from the sum returned and is not subject to return.
5. Delivery and acceptance
5.1. After the contract has entered into force according to sect. 3.4, the ordered product will be delivered to address specified in the order. The time of delivery will be arranged with the customer in advance by telephone specified in the order.
5.2. The courier will deliver the product along with the necessary documents within the time period specified in the product card.
5.3. Should the ordered product be out of stock and subject to special order from the supplier, and cannot be possibly delivered in time period specified in the product card, as well as other situations where the timely delivery is not possible due to circumstances which Smart-home cannot be held responsible for, we will inform the customer by telephone or e-mail specified in the order in 2 business days period from the moment the contract becomes operational according to sect. 3.4 of the present Terms, and will arrange a new product delivery time.
Should you lose your interest towards the product due to an excessive delivery time, you have the right to cancel the order (see sect. 6.1. and 6.3. for more info), and we will refund the sum you paid for the product along with the transportation costs.When purchasing porudcts on order, you will receive an invoice for the 50% prepayment.
5.4. After the ordered product is passed to the courier, the latter will arrange the delivery time with you in advance.
5.5. The courier will deliver the product to address specified in the order. Delivery address cannot be changed after the order is placed.
5.6. Please double check the billing and shipping info in order to prevent delays and discrepancies while delivering the product. Smart-home and the courier are not responsible for delivery delays and discrepancies should such delay or discrepancy be caused by inaccurate or incorrect data submitted by the customer.
5.7. The courier delivers the ordered product along with the delivery note. Before signing the delivery note, please check the package condition. If the the pachage appears to be damaged while tranporting, please make a relevant record on the delivery note. We recommend to make a photo of the damaged goods and send it to info@smart-home.ee and contact the client service immediately via e-mail info@smart-home.ee. Products damaged during transportation will be replaced.
5.8. Delivery conditions are valid within the territory of the Estonian Republic only. Should the order be made with the intention to deliver products abroad, please contact the customer support cener.
5.9. Product installation and old product removal services are not offered on the small islands.
6. Cancelling the order and returning the product
6.1. You have the right after paying for the product, but before product delivery, to cancel your order by sending a corresponding message along with order number and your bank account number to e-shop e-mail address info@smart-home.ee
6.2. After receiving the product you have the right to familiarize yourself with it during 14 days time. If for some reason you are not satisfied with the purchased product, you have the right to return it in 14 days time by sending a corresponding message using the feedback form. Should the returned product have a signs of depreciation, Smart-home has the right to refuse accepting the product or make an arrangement concerning the amount of compensation for the depreciated product. To settle the payments Smart-home will send a deduction application to the customer’s e-mail address specified in the order. Should the customer not agree with the amount of deduction, he or she has the right to involve an independent expert to determine the amount of product’s depreciation. The cost of expertise is split equally between the customer and Smart-home, unless one of the parties has claims, which are obviously unreasonable. In this case the cost of expertise is to be borne by the party, whose claim is obviously unreasonanable.
6.3. The returned product must be fully complete, in original packaging (should contain all the items contained in the product packaging: cables, plastic bags, polystyrene foam packaging, etc.). Should the product be purchased during a campaign with some other product bundled with it, the whole bundle is to be returned (i.e. all the products).
6.4. Return policy does not apply to products ordered in accordance with client's personal specifications or custom-made according to conditions set out by the client.
7. Return of the products not meeting the requirements
7.1. Smart-home is responsible for all inconsistencies and defects, which appear in 1 years time (for physical persons) / in 1 year time (for legal persons), starting from the moment of product acceptance.
7.2. Smart-home is not responsible for:
a) Damage or degradation of the product caused by the client or the third party.
b) Defects caused by inappropriate use of the product.
c) Normal physical wearing caused by the normal usage.
7.3. Should the product be defective or not meet the reqirements, the customer has the right to demand the product to be replaced with the product meeting the requirements and free of defects, or revoke the order and return the product not meeting the requirements to Smart-home.
7.4. Should the product not meeting the requirements be returned, the sum paid for the product (including the transportation costs) will be refunded no later than 14 days after revoking the order and receiving the notification on revoknig the contract.
7.5. Apart from the rights subsequent to the guarantee terms, the client also has other rights in accordance with the applicable legislative acts in force.
8. Liability and Force Majeure
8.1. Smart-home and the customer are mutually liable for any damage caused to another party by not complying to the present terms in amount and in cases provided for by the applicable European Union legislative acts.
8.2. Smart-home is not responsible for the damage incurred to the cusomer as well as product delivery delays, should such damage or delivery delay be caused by circumstances beyond Smart-home control, and occurrence whereof Smart-home did not foresee and could not have possibly foreseen (Force Majeure).
9. Other conditions
9.1. All the personal data, submitted by the customer while visiting and effecting purchases in Smart-home e-shop are conseidered confidential. A protected data transnission channel with the bank guarantees the security of personal data and bank transactions. Smart-home e-shop has no access to these data.
9.2. All matters not covered by the present terms are to be resolved based on the applicable legislative acts of Estonian Republic.
9.3. Disputes emerged due to ordering and purchasing of the goods via Smart-home online store between You and Smart-home are being settled by negotiation. In case if the agreement was not reached You have the right to apply to protect Your rights via Consumer Protection Board to Commission on Consumer Complaints or to Tallinn City Court. The consumer may file a complaint independently or by proxy. At the resolution of disputes the existing legislation of The Republic of Estonia is being taken into account.
